Hi everyone. Like many people who visit this forum, this is not the only forum i visit. In fact I'm a moderator on a another forum. Anyway At this other forum which I'm a mod at, a fabulous lady rescued two macaws.

The man before who had these macaws electrocuted one, and neglected and abused both. The one which was electrocuted was a Blue and gold macaw, who also suffers from a severely wing damage. His shoulder was shattered, his wing was broken in two places, both of which the man neglected to repair.

Spazz, the B&G, has already under gone one surgery since he has been in his new home. He now has 2 pins in one wing, and 1 pin in the other. However Spazz's wings still are in horrible condition, and still hang, and his new owner fears that they will have to be amputated.

Suzie, the other macaw, which is a scarlet, also came from the same man as Spazz. Luckily however, not in as bad conditions. Suzie suffered from a scab on his chest from plucking, and various other plucked spots. Suzie is now however healed.

However Spazz still needs a lot of medical care and attention. The lady still needs to pay off the rest of the mans adoption fee. The man has asked an adoption fee of $1300 for both. the lady has paid off most of it, but still needs $400 dollars. As you can imagine, all this medical care, adoption fees, and the fact that she is a mother of three kids, and a breeder, that all adds up. Unfortunately she can't afford afford to pay it all on her own. This is where we step in.

We are holding a raffle to help raise money for this lady so we can help her pay off the adoption fee and at least some of the medical bills.

We need at least 400$ by September 10th, or the man is taking back the both birds, and returning them to the original state. Plus the $800 that this lady has paid on these macaws vet care so far will be also a loss.

This is where i was hoping i could get a little help from you.

The raffle has many GREAT prizes, including a bearded dragon, a gecko, a home made hanging perch, a custom made picture frame and many other cool things. All these things have been donated by members, and we hope to get more things up.

It's $2 a raffle ticket, you can buy as many tickets as you like. You choose the item you want, and buy a ticket for it.

You do NOT have to be a member of this forum to participate in it.

There is also talk of a baby GCC being donated.

I believe to qualify to get the animals you must be in the USA. Canada may qualify too, but I'd have to check on that to be sure. This is just for shipping and security reasons. The items I'm sure can be shipped world wide.

I'm afraid I just wouldn't pay another cent to this man, what can he do really. He neglected and abused both birds which is gonna cost her a fortune could she not get the vet to stand up for her. She IS paying for these birds in medical care, which this man (and I use the term loosely) should have been paying for (they should have been in his care in the first place.

Has she had a word with the vet and the rescue places to find out how she stands on that score. I mean what can this man do really, as soon as the rescue places are aware of what he did to these birds.

If he even threatened to take them back I would tell him in no uncertain terms that I would be having words with the rescue places. God makes me so darn mad. :mad:

yeap, He can't just take them back ... I would put up a fight about this one and, unless there was a written contract stating the cost of the adoption fee, and receipts showing her payments, she doesn't have to pay him one more cent - especially if there was a bunch of vet bills incurred with the adoption ... nope, I would agree with Peta - he doesn't get one more penny/pence/"smallest denomination of her currency"!

I would think an inquiry to the ASPCA is in order. She needs to arm herself with available facts and information about where she stands legally.

I would think the threat of ASPCA involvement and the threat of animal cruelty allegations would be enough to make this man rethink his stance and withdraw his claim to these creatures and any funds he wrongfully feels are due him.

I'm very glad somebody took these birds away. I'm with everyone else here and having him reported, but I can also understand not wanting him to get these birds back. Did she have a contract for the adoption of these birds. I know many people and places that rescue animals, you sign a contract stating you can not get the animals back once signed. She should see if there is any way to press animal cruelty charges on this *****.

I love the reptiles they are beautiful. Meghan you8 should find out about shipping to Canada. I think I'll get some raffle tickets for sure on that necklace, they are really nice.

Yes she has talked to various places. She can't do much until they're actually hers. Once she gets them paid off she said she's going to look into going to court and get him to pay for all the damage and stuff he's done to these macaws. BUT they're not legally hers yet until she pays off tehr est of the 400$

Ah well no contract no more money. If she is really going to pay this idiot (remembering to keep it clean) :eek: then I would definately get this contract. I'm not even sure if that is a legal way of doing things. I would have words with a few people in the know about that one.

hmm, sounds a little fishy ... "believe there is a contract, but it is not in play"? ... That doesn't make sense. The contract, would in part, obligate and officiate the legal doings and goings ons ... if there is a contract, it would be in play upon exchange of monies and taking possession of birds.

:confused:

Or, am I reading this wrong? :confused:

I don't think the woman wants to argue or fall out with the man until she's paid off what she owes him. These birds are not hers until she pays him the last 400$ so she can't argue anything. She has asked rescues, etc. That is what they said. IF she argued and made a big deal with this to begin with, it could take forever, mean while the birds are being tortured. She just wanted them out ASAP she will deal with him AFTER she has paid for the birds.

No the contract was so he couldn't change his mind and take back the birds during the time he gave her to get the money. If she went over the due date and still hadn't paid the money, then that's different and in that case he could.

This is where the laws are going to get tricky - if the birds are in her possession then the payment that is stated in "the contact" could be considered "good faith" and if the original owner of the birds does anything to impede that payment (such as taking the birds back) it could void the whole contract ... it is also going to depend on the wording in that piece of paper ...

if there isn't a piece of paper in play here and she has the birds ... well, this could get interesting ...

I think this is a very sticky situation.

I hate animal abuse. There is never an easy legal solution to this very real problem..

Think there are some very good points there, Meghan please let this lady know, I would hate for her to be paying this idiot, and vets bills, only for the idiot to decide he's taking them back.:mad:

Couldn't she just use the receipts from the veterinarian to offset the ridiculous adoption fee? Would this man have still expected to receive money if the birds had died from the poor care they received from him, had they not been seen by a vet?
I would call whoever is in charge of animal abuse in the area. The vet can prove the animals were abused. This is just ridiculous, she's trying to do a wonderful thing and look whats happening. What a horrible man. I sure hope Karma hits home fast.

There IS a contract, but its basically so he can't take the birds back at anytime during the time he has given her to get the money. HOWEVER if she goes past the time (sept 22) and still does not have the money he CAN take back the birds. BUT if she has the money by Sept 22 than there hers forever.

They are DNA'd (both male) and i beleive they have leg bands, not sure if they are micro chipped, i doubt it though.

Ok after relooking at some of the picture of Spazz and Suzie, i now have a more valid answer. Suzie i know for fact has a legband(the scarlet). and i can't see one on Spazz but it could be jsut thepicture or something. I don't know if they're microchipped though.

Ok since you guys dont seem to be understanding thisnlet me tell you again:

The woman just wants to pay off the money right now. Then she wants to get Spazz's wing all better, and THEN she will work on getting the money back. SHE CANNOT DO ANYTHING UNTIL THEY ARE HERS, SO SHE HAS TO PAY OFF THE BIRDS BEFORE SHE FIGHTS HIM. She already has a lawyer lined up and this is what they told her.

She has, She has, she has, She has tried EVERYTHING.

No she cannot use the receipts. The man i don't think gives a hoot about the medical condition or bills of these birds sicne he failed to take spazz in to the vet when he has a severely broken wing. and now because of him his wing may have to be amputated. So no they ha dnot been seen by vet in the man's hands. In the womans hand she took them both the vet ASAP.
